Bersatu takes legal action against RoS

PARTI Pribumi Bersatu Malaysia has filed an originating summons at Kuala Lumpur High Court to stop the Registrar of Societies (RoS) from making statements against the party lead by Dr Mahathir Mohamad, said lawyer Haniff Khatri Abdulla.

The Bersatu lawyer said they wanted the declaration as RoS is not working within the law.

“If they say Bersatu doesn’t follow the provisions in the constitution then RoS should be following the law.

“What they are doing is making public statements Bersatu can be deregistered and that is not right.

“What RoS is doing is against the law and we want to stop them from making any statements,” he said at the Kuala Lumpur High Court lobby today.

Bersatu will contest 52 parliamentary seats in the 14th general election but is locked in a dispute with  RoS which had refused to register it.

Haniff said Bersatu is requesting four declarations and an injunction against RoS.

“Bersatu wants a declaration RoS is responsible for carrying out duties under the Societies Act and if RoS wants to conduct any investigations against Bersatu it must follow the provisions under the Societies Act.

“Bersatu also wants a declaration statements given by RoS is mala fide and against the Societies Act and any complaints RoS receives must be investigated under the Act.

“Lastly the injuction is to prevent RoS from making any statements until the court proceedings are over.”

Haniff said RoS should stop making statements Bersatu is in breach of its prosecution of the law and can be deregistered. 

“RoS’ statements Bersatu had made various mistakes under its constitution and the Societies Act were carried by the media in November 2017 and early this year.

“Bersatu has tried to contact RoS but there was no response.”

Haniff said since Bersatu was registered in 2016 it has abided by its constitution that was approved by RoS.

“We hope the court will look into the matter and give a fair judgement on whether RoS has broken any laws.” – February 22, 2018.
