UNTIL today, Umno politician Mazlan Ismail had not produced the thousands of letters he claimed he possessed which allegedly linked the late Karpal Singh and Anwar Ibrahim to corruption, the court heard today.
“The PKR office, my office and Karpal’s office never received any letters. Karpal and I did not receive any information that he (Mazlan) has delivered (the letters) to our office. Up until today he has not handed over any letters,” said Anwar, in reply to a question from his lawyer Sangeet Kaur Deo during a hearing on his defamation suit against Mazlan, TV3 and Utusan.
Mazlan is the Malaysian Communications and Multimedia Commission chief operating officer, and the former Barisan Nasional Permatang Pauh candidate.
Anwar is suing the three parties for defamation over TV3 and Utusan’s reports of Mazlan’s claim that more than 6,000 letters linking Anwar and Karpal to graft were in his possession.
“A person is responsible only for the words that he utters. Even if the media goes on to summarise what he has said, they have to use the words that Mazlan used. This is what we want to establish (to show) whether what my client said is defamatory,” said Mazlan’s counsel Hasnal Rezua Merican after the court adjourned
“The letters contained defamatory information but my client has said that he cannot comment as he subjected to Bafia and he will let Anwar and Karpal explain (their roles in it).”
DAP leader Karpal Singh was killed in a road accident in April 2014.
In news reports published in 2013, Mazlan told the media that he could not comment on the content of the letters as he was subjected to the Banking & Financial Institutions Act, 1989 (Bafia).
The court session ended at noon because of Anwar’s daily physiotherapy appointment.
The trial ending on Thursday will see Anwar, Tv3 and Utusan reporters take the stand.
There was some tension in the court earlier when supporters of Anwar demanded to know why they were not allowed to sit in the first row.
“Ada makan dedak ke?( Have you taken a bribe?). This is public space. Why are we not allowed to sit here?” said one of the supporters.
The group calmed down after the court supervisor told them to to be respectful and mindful, and asked the spectators to be quiet as the session was about to start
Anwar last year filed suit against Mazlan Ismail, Sistem Televisyen Malaysia (TV3), and Utusan Melayu (M) Bhd.
He alleges that Mazlan had caused TV3 and Utusan Malaysia to carry publish news that defamed him in 2013.
Anwar is suing for compensation and an injunction to stop the defendants from repeating or airing the defamatory allegations. – January 22, 2018.
