Gallows for gardener for having 500g of cannabis


A GARDENER was sentenced to death by the Kuala Lumpur High Court today after he was found guilty of trafficking 488g of cannabis three years ago.

Judge Ahmad Shahrir Mohd Salleh handed down the sentence on Mohd Zamri Saidin, 53, after finding that the defence had failed to raise reasonable doubt at the end of the defence case.

In his brief judgement, Shahrir said the evidence in the defence’s case was clearly contradicting the narrative of the prosecution case.

“The evidence in the prosecution’s case led to the discovery of a black plastic bag containing the cannabis in the basket of a Yamaha motorcycle ridden by the accused while the defence’s evidence stated that the plastic bag was found at the compound of a house in Kampung Baru here,” he said.

Zamri was charged in front of a house in Kampung Baru on March 8, 2018.

The charge was framed under Section 39B (1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 39B (2) of the same act, which carries a death penalty by hanging or life imprisonment and also liable to no less than 15 strokes of whipping.

A total of nine prosecution witnesses and three defence witnesses, including the accused, were called to testify during the trial.

Deputy public prosecutor Fatin Hanum Abdul Hadi appeared for the prosecution while the accused was represented by lawyers Luqman Mazlan, Rosal Azimin Ahmad and Muhammad Amiraizat Abdul Rani. – Bernama, April 1, 2021.
