Businessmen plead guilty to assaulting restaurant workers, diners


TWO company directors, one of them a “Datuk” today pleaded guilty in the Petaling Jaya Magistrate’s Court to assaulting workers and diners at a restaurant, actions that were captured on a video that went viral.

Tan Wai Khan, 42, and his friend Ang Mow Loong, 40, conceded guilt in the case that occurred in a restaurant at Tropicana Avenue in Damansara. 

Magistrate Nurshahira Abd Salim fixed April 2 for sentencing.

They were accused of voluntarily causing hurt to Kwan Pei Choong, 31, at the restaurant at 9pm on January 12, and charged under Section 323 read together with Section 34 of the Penal Code, which provides for a jail sentence of up to a year, a fine of up to RM2,000 or both, upon conviction.

They were also jointly charged with being a public nuisance at the same place and time, under Section 290 read together with Section 34 of the Penal Code, which provides for a maximum fine of RM400.

Tan also pleaded guilty to two charges of assaulting and injuring Magdalene Wong Chung Yi, 31, and her friend Lee Dek Quan, 25, at the same place and time.

However, he denied a charge of committing mischief by breaking crockery belonging to Kwan.

The offence under Section 427 of the Penal Code is punishable by up to a year in jail, a fine, or both. The court fixed April 2 for case mention.

Deputy public prosecutor Siti Zubaidah Mahat offered bail at RM7,000 with one surety for each charge against both accused, but their awyer Suraj Singh asked for the sum to be lowered on the grounds his clients had cooperated with investigators and were not flight risks.

The court granted Tan bail at RM10,000 with one surety and Ang, at RM4,00 with one surety for all the charges.

A short video has been widely shared on social media showing the incident in the case.  Police said Tan became violent after he was told to lower his voice by a fellow diner.   – Bernama, January 21, 2021.z
