Court of Appeal rejects Perak exco’s bid to transfer rape trial


THE Court of Appeal today dismissed an application by Perak exco Paul Yong to transfer his rape trial from the sessions court to the high court.

The majority decision was made by justices Yaacob Md Sam and Kamaludin Md Said. Judge Rhodzariah Bujang dissented.

Yaacob said there is no appealable error on the part of the judicial commissioner in refusing Yong’s application to transfer the case to the high court.

He affirmed the high court’s decision on November 26 last year to dismiss the exco’s transfer application under Section 417 of the Criminal Procedure Code.

Yong, 50, has pleaded not guilty at the Ipoh sessions court to raping his 23-year-old Indonesian maid.

The Tronoh assemblyman is accused of committing the offence at his house in Meru Desa Park between 8.15pm and 9.15pm on July 7 last year.

His lawyer, Rajpal Singh, told reporters that the defence will file an appeal at the Federal Court against today’s ruling. – Bernama, February 10, 2020.
