TERESA Kok has filed a defamation suit against Selangor PAS Youth chief Syarhan Humaizi Halim over his Facebook posting which had labelled her as being anti-Islam.

In the suit filed at the Kuala Lumpur High Court on February 4, the primary industries minister is seeking damages from Syarhan for defaming her.

The Seputeh MP is also seeking an injunction to stop Syarhan and/or his agents from repeating his defamatory remarks against her.

In her statement of claim, the DAP leader said the article posted by Syarhan on his Facebook page on January 19, 2019 was derogatory and defamatory, and meant that she is against Islam, a racist and bigot, and a dishonest minister who is untrustworthy, deceitful and unethical.

Kok also took offence to another article which Syarhan had referred to in his writing, saying that the second article too was derogatory and defamatory.

In his article, Syarhan had criticised DAP for having their own agenda against Islam, and he had referred to an article published in Malaysia Today which had labelled Kok as being against Islam as the official religion of Malaysia.

Kok’s statement of claim stated that the articles were bereft of truth, motivated by malice and calculated to tarnish her good name and character.

Two weeks ago, Kok sent a demand letter to Syarhan, urging him to immediately retract his writing from his Facebook page and tender an apology to her. She also demanded damages of RM30 million from him.

In her statement of claim, Kok said Syarhan refused to comply and he, in his reply to her demand letter, had said he would rely on the defence of fair comment in posting his article.

Kok is also seeking all legal costs incurred.

Her legal action was filed by SN Nair and Partners. – February 7, 2019.
