MIC’s Sivarraajh wins court order to challenge EC decision on Cameron Highlands

THE Kuala Lumpur High Court has allowed MIC vice-president C. Sivarraajh to challenge the Election Commission’s decision to bar him from contesting in the Cameron Highlands by-election.

Justice Nordin Hassan made the decision after hearing submissions from lawyer Vasanthi Arumugam.

The court then fixed Thursday afternoon to hear the merits of the application.

“The court has decided to hear the merits of the application this Thursday,” Vasanthi told reporters. 

The hearing on Thursday comes two days before the filing of nominations on Saturday. Polling will be held on January 26.

Nordin ruled that there was an “arguable” case in granting leave to Sivarraajh.

The EC had, on December 28, declared Sivarraajh ineligible to contest the Cameron Highlands by-election as he had been implicated in corrupt practices to win the parliamentary seat during the 14th general election.

Its chairman, Azhar Azizan Harun, had said the decision was made after referring to legal advisers on the former MP’s eligibility for the Cameron Highlands seat.

He said Sivarraajh was also barred from registering as a voter or contesting as a candidate for any election for five years from December 13, 2018.

MIC and Sivarraajh have not appealed the election court ruling that annulled his election in GE14, and only filed a judicial review against the EC decision to suspend the party-vice-president.

Despite the uncertainty over the judicial review’s outcome, MIC is going ahead with preparations for the by-election.

The Cameron Highlands seat was won by BN in GE14, with Sivarraajh winning 10,307 votes against Manogaran’s 9,710 votes in a five-cornered fight. – January 7, 2019.

  • Of course you can challenge.....but the final decision will be your challenge will be thrown out...and you will still be debarred
